1. Who We Are and Acceptance

Sparkling is operated by Swarming Labs Ltd (BVI). sparkling-card.org is the Sparkling website for users in Canada. Using this site, the official bot or the browser app means you accept these terms and the Privacy Policy.

2. Eligibility

  • You have reached the age of majority in your province or territory and can enter into a binding contract.
  • You are not subject to sanctions and are not using the service from a sanctioned region, such as Iran, Syria, Cuba, North Korea or the Russian-occupied parts of Ukraine.
  • You will not use a product that is restricted where you are, including in your province, and you will not hide your location to reach it.
  • You will complete identity verification if Sparkling asks for it.

3. The Service

Sparkling is self-custodial software. It lets you prepare and sign crypto swaps across supported networks, and, where they are offered, other products such as perpetual futures on Hyperliquid and Lighter, BTC and ETH Up/Down options, pre-IPO perps, prediction markets and tokenized stocks, assisted by an AI agent that drafts each order. In Canada these other products follow provincial securities rules and are shown only where they are open. An order goes through only once you have approved it yourself. Products differ by country and province and may be added, changed or withdrawn.

4. What Sparkling Is Not

The service is not a bank, investment dealer, adviser, portfolio manager, custodian or crypto trading platform registered in Canada, and it does not hold your assets. Nothing on this website or in the app is a recommendation, an offer of securities or personalised financial, legal or tax advice.

5. Risks You Accept

  • The value of crypto assets can fall sharply, and you can lose everything you trade.
  • A stablecoin may trade below its target, and an issuer or its reserves may fail.
  • Smart contracts, bridges, networks and partner services can be attacked, delayed or stop working.
  • Execution can happen at a different price from the quote, and network costs are never returned.
  • A confirmed blockchain transaction cannot be cancelled or reversed.
  • Rules and taxes in Canada and elsewhere can change and affect what is available.

6. Your Obligations

Provide accurate information, keep your email, Telegram account, devices and recovery phrase secure, read every trade card before confirming and tell support promptly about unauthorised access. Do not use the service for unlawful purposes, fraud, money laundering, sanctions evasion, market manipulation, automated scraping, distributing malware or impersonating others.

7. Compliance Measures

Sparkling may screen transactions, request information, and limit, suspend or close an account when legally required or when these terms are breached.

8. Fees and Taxes

Any Sparkling fee is shown on the trade card before you confirm. Network and partner fees may also apply. You are responsible for reporting and paying your own taxes, including to the Canada Revenue Agency.

9. Content and Trademarks

Sparkling and its logo belong to Swarming Labs Ltd. You may read and share the content of this website for personal, non-commercial use. Names of other services mentioned here belong to their owners and are used only to describe how the app works.

10. Third-Party Services

Wallet infrastructure, liquidity and payment providers and market venues such as Hyperliquid, Lighter and Polymarket follow their own conditions, and Sparkling does not answer for what they do, decide or fail to deliver.

11. Liability

The website and the service are provided as they are and as available. As far as the law permits, Sparkling bears no responsibility for consequential or indirect damage, trading results, price swings or outages of partner services, and the most it can owe you is US$100 or the fees you paid over the last year, whichever is higher. Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded, including in Quebec.

12. Ending Use and Changes

You are free to leave and close your account whenever you wish. Access can be paused or ended by Sparkling, for instance for misuse or because the law requires it, and where permitted you will have fair time to move your assets first. Significant changes to these terms are published no less than 30 days before they apply.
